Official Rules
PLEASE READ THESE OFFICIAL RULES BEFORE ENTERING THIS SWEEPSTAKES. BY SUBMITTING AN ENTRY YOU AGREE TO BE BOUND BY THESE RULES AND ACKNOWLEDGE THAT YOU SATISFY ALL ELIGIBILITY REQUIREMENTS.
THE FOLLOWING PROMOTION IS OFFERED ONLY WITHIN THE UNITED STATES AND SHALL BE EVALUATED ONLY ACCORDING TO UNITED STATES LAW. DO NOT PROCEED IF YOU ARE NOT CURRENTLY A RESIDENT OF, AND LOCATED IN, ONE OF THE 50 UNITED STATES OR THE DISTRICT OF COLUMBIA. YOU MUST BE AT LEAST 21 YEARS OLD AT THE TIME OF ENTRY TO BE ELIGIBLE.
Eligibility
This Sweepstakes is open to legal residents of the 50 United States and the District of Columbia, who are 21 years of age or older ("Entrant"). Employees, officers and directors of Montage Hotels & Resorts, LLC ("Sponsor"), its affiliated companies, subsidiaries, advertising and promotional agencies, and the Immediate Family Members and Household Members of each, are ineligible. "Household Members" shall mean those people who share the same residence at least three months a year. "Immediate Family Members" shall mean parents, grandparents, step-parents, legal guardians, children, step-children, siblings, step-siblings, or spouses. Proof of eligibility will be required. Void outside of the 50 United States, the District of Columbia and where prohibited, taxed or restricted by law.
Sweepstakes Period
Montage Twitter Sweepstakes ("Sweepstakes") begins at 12:01 AM Pacific Daylight Time on July 27, 2010, and all entries must be received by 11:59 PM Pacific Daylight Time on August 3, 2010 ("Sweepstakes Period"). All eligible entries received during the Sweepstakes Period will be included in the drawing for the Prize.
Sweepstakes Entry Instructions
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS GIVEAWAY. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING.
During the Promotion Period, visit @MontageBH account on Twitter (http://twitter.com/MontageBH) ("Sponsor's Twitter Page") to receive instructions on how to enter the Promotion. Prior to doing so, you will be prompted to sign into your Twitter account. If you do not have an account, visit www.twitter.com to create one. Twitter accounts are free. Once logged into your Twitter account, follow the links and instructions to become a follower of @MontageBH. Any time during the Promotion Period post the following tweet exactly as it appears below ("Entry Tweet"):

Normal internet access and usage charges imposed by your internet provider will apply. It is the Entrant's sole responsibility to notify Sponsor if his/her email address and/or postal address changes. For entry into the Sweepstakes without following @MontageBH on Twitter and posting the requisite Tweet, mail a 3" x 5" postcard containing your complete name, address (including zip code), a valid email address (if available) and phone number to: Montage Beverly Hills, Twitter Sweepstakes, 225 N. Canon Drive, Beverly Hills, CA 90210. Mail-in entries must be postmarked no later than August 3, 2010.
During the Promotion Period, you will automatically receive one (1) entry into the Promotion for each Entry Tweet you post. You may post no more than once per day. All entry information and tweets shall be collectively referred to herein as the "Entry" or each as an "Entry."
If more than one (1) post per day is received from a household, postal address or email address during the Sweepstakes Period, all additional entries submitted by that household, postal address or email address will be void. Each Entrant must be the rightful owner (or have authorized use) of the Twitter account used for entry. In the event of a dispute as to the identity of an Entrant or winner, the Entrant or winner will be deemed to be the natural person in whose name the email account is registered. Incomplete, unreadable, or unintelligible entries will be disqualified. Entrants must complete all entry requirements to be eligible to win.
If you post updates to or receive updates from Twitter.com via SMS from your wireless phone, your wireless-service provider may charge you for each text message you send and receive. Please consult your wireless-service provider regarding its pricing plans. You must be an active holder of a non-private Twitter account and be a follower of the @MontageBH account to be eligible to enter this Promotion. All terms and conditions of Twitter.com apply. Multiple entrants are not permitted to share the same Twitter account. Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different Twitter accounts, identities, registrations and log ins, or any other methods will void that entrant's entries and that entrant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. In the event of a dispute as to any Twitter account, the authorized account holder of the e-mail address used to register at Twitter.com will be deemed to be the entrant. The "authorized account holder" is the natural person assigned an e-mail address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address. Each potential winner may be required to show proof of being the authorized account holder.
All Entry Tweets must appear exactly as above; any posts that are not identical to these tweets will result in disqualification from the Promotion. Consistent with the foregoing, you agree to include the disclosure statement "#sweeps" in each Entry Tweet in order to comply with the FTC's "Guides Concerning the Use of Endorsements and Testimonials in Advertising" (16 C.F.R. Part 255), located at http://www.ftc.gov/os/2009/10/091005revisedendorsementguides.pdf. If you do not include the disclosure statement, Sponsor reserves the right to remove your Entry from consideration in the Promotion and disqualify you and your Entry, and you agree to remove any Entry lacking proper disclosure from Twitter.com and any other website(s). All entries become the sole and exclusive property of the Sponsor and receipt of entries will not be acknowledged or returned. Sponsor is not responsible for lost, late, illegible, stolen, incomplete, invalid, unintelligible, postage-due, misdirected, technically corrupted or garbled entries, which will be disqualified, or for problems of any kind whether mechanical, human or electronic. Proof of submission will not be deemed to be proof of receipt by Sponsor. By entering the Promotion, entrants fully and unconditionally agree to be bound by these rules and the decisions of the judges, which will be final and binding in all matters relating to the Promotion.
Entrant Obligations
Entrants are subject to, and must comply with, the Sweepstakes' Official Rules and all terms of use and policies of Sponsor's web site. Please read all such rules, terms of use, instructions and policies carefully before participating in this Sweepstakes. By entering, Entrants represent that they are eligible based on the requirements provided in these Official Rules, and agree (a) to be bound by these Official Rules, (b) to indemnify, release and hold harmless Sponsor, its subsidiaries, affiliates, directors, officers, employees, and agents from any and all liability for any injuries, losses, or damages of any kind caused by any prize or resulting from acceptance, possession, use, or misuse of the Prize or any Prize-related activities, and (c) to Sponsor's use of Entrants' personal information as described in the Privacy Policy located at www.montagehotels.com/privacy-policy.php. Except where prohibited by law, entry constitutes permission without further consent to use the winner's name, hometown, likenesses, and photographs for broadcast, online posting, and/or in any other media, including for advertising and publicity purposes, without limitation or additional notice or compensation (such consent being optional for Tennessee residents).
Sponsor is not responsible for error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or technical, network, telephone equipment, electronic, computer, hardware, or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry, winner or other Sweepstakes information by Sponsor or Entrants for any reason whatsoever. Sponsor is also not responsible for any injury or damage to any Entrant's or any other person's computer or device related to or resulting from downloading any materials in the Sweepstakes or for entries that are late, misdirected or incomplete, lost, stolen, illegible or damaged. All entry materials may be maintained as part of Sponsor's Sweepstakes records. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATIONS OF THE SWEEPSTAKES IS A VIOLATION OF THE CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW. Any such entries received from an Entrant who has made an attempt to undermine the legitimate operations of the Sweepstakes will be disqualified. Sponsor reserves the right to cancel or modify the Sweepstakes if it becomes technically or otherwise corrupted.
The Prize
The winner will receive a prize ("Prize") consisting of one (1) Superior Guestroom (maximum occupancy two (2) persons) at Montage Beverly Hills (the "Hotel") for three days/two nights and a private pastry lesson with Chef Ruskell. The approximate retail value of the Prize is $4150.00. Both winner and his/her guest must be 21 years of age or over. The winner is solely responsible for all travel-related and other expenses not expressly stated in the Prize description, including airfare and/or ground transportation to and from the Hotel and all unspecified incidentals (including, but not limited to, meals, beverages, gratuities, phone calls).
Winner must reserve his/her stay at least thirty (30) days in advance of arrival and complete the stay by August 4, 2011. Dates of stay are subject to availability and certain restrictions, including blackout dates, may apply. If winner is unable to use the Prize within the designated dates, winner will be disqualified, Prize forfeited and no additional compensation will be awarded. In the event that Chef Ruskell is not available on the desired dates of the prize redemption, an alternative Montage Chef will be provided for instruction.
The Prize cannot be redeemed for cash or substituted for any other items by the winner. The winner cannot assign or transfer the Prize, or any portion thereof. Sponsor reserves the right to substitute a comparable prize of like or greater value, including cash, for the Prize (or any portion thereof) for any reason. The winner is responsible for all local, county, state, and federal taxes on the Prize based on the value set forth in these Official Rules. All prizes will be awarded that are properly claimed in accordance with these Official Rules.
Odds of Winning; Selection of Winner
Odds of winning depend on the number of entries received. One winner will be selected by random drawing from among all valid entries on or about August 4, 2010. The winner will be notified by email, Twitter or U.S. Mail on or about August 4, 2010 and the winner will be posted on the Sweepstakes' website. If contacted via Twitter, the potential winner will be required to respond to the direct message or @reply. The winner and guest will be required to complete, sign and return a Certification of Eligibility and Release and claim the Prize in a manner determined by Sponsor, in its sole discretion, within 14 days of the date of notification or they will be disqualified. If a winner cannot be reached, or if a winner does not return the signed and completed Certification of Eligibility and Release and claim the Prize within the designated time period, the Prize will be awarded to an alternate winner selected by random drawing. By entering the Promotion, entrants fully and unconditionally agree to be bound by these rules and the decisions of the Sponsor, which will be final and binding in all matters relating to the Promotion.

Sweepstakes rules are available at http://www.montagebeverlyhills.com/ruskelltwitterpromo.php and Monday through Friday during normal business hours at Montage Beverly Hills, 225 N Canon Drive, California 90210 through September 30, 2010.
The winner will be posted on http://www.montagebeverlyhills.com/ruskelltwitterpromo.php. Requests for the name of the winner may be submitted, along with a separate, self-addressed, stamped envelope to: Montage Hotels & Resorts, 225 N Canon Drive, California 90210, Attention: Twitter Sweepstakes, no later than September 30, 2010.
General Rules
This Sweepstakes is subject to all applicable laws and regulations and is void where prohibited or restricted by law, including without limitation, in jurisdictions requiring registration, filing, trust account, or posting of a bond, or any other requirements or disclosures that are not expressly satisfied by these rules. Sponsor is not responsible for typographical or other errors in the printing, offering, or administration of the giveaway, or in the announcement of the Prize.
This Sweepstakes is governed by the laws of the United States and the State of California, without respect to conflict of law doctrines. As a condition of participating in this Sweepstakes, Entrants agree that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or in connection with this Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively before a court located in California having jurisdiction. Further, in any such dispute, under no circumstances will Entrants be permitted to obtain awards for, and hereby waive all rights to claim punitive, incidental or consequential damages, including attorneys' fees, other than participant's actual out-of-pocket expenses (e.g. costs associated with entering), and Entrant further waives all rights to have damages multiplied or increased.
Additional Terms
Any attempted form of entry other than as set forth above is prohibited; no automatic, programmed; robotic or similar means of entry are permitted. Sponsor, its affiliates, partners and promotion and advertising agencies are not responsible for technical, hardware, software, telephone or other communications malfunctions, errors or failures of any kind, lost or unavailable network connections, website, Internet, or ISP availability, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture of entry information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed computer transmissions which may limit one's ability to enter the Promotion, including any injury or damage to participant's or any other person's computer relating to or resulting from participating in this Promotion or downloading any materials in this Promotion. Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, extend or suspend this Promotion should (in its sole discretion) virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Promotion. In such case, Sponsor may select the winners from all eligible entries received prior to and/or after (if appropriate) the action taken by Sponsor. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering with the entry process or the operation of the Promotion or website. Sponsor may prohibit an entrant from participating in the Promotion or winning a prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Promotion by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or Sponsor representatives.
